The Ministry of Justice Reforms, which have resulted in changes to the Civil Procedure Rules, take effect from today, 31 July 2013.
These are fundamental changes aimed predominantly at reducing the cost of personal injury litigation on Employers Liability and or Public Liability claims with a value up to £25,000. From 31 July 2013 all employers liability and public liability personal injury claims with a value up to £25,000 will be managed through an online system called the Claims Portal.
If a personal injury claim is made against you on or after 31 July 2013, you will receive a Claim Notification Form (EL1) or (PL1). Receiving a letter requesting your public liability or employers liability insurers’ contact details could also indicate that a claim is likely to follow.
Due to the speeded up process it is vital that El and PL insurers are notify of the potential claim straight away. Insurers will apply restrictions to their policy wordings so the important thing is that these instances are notified without delay as failure to do so could invalidate cover.
